Victory At Last! DOMA is Found Unconstitutional By The US Supreme Court! Proposition 8 Found To Have No Standing

The Supreme Court has just struck down the 1996 federal Defense of Marriage act this morning, which denied federal benefits to lawfully married same-sex couples, ruling DOMA is unconstitutional as a deprivation of the equal liberty of persons that is protected by the Fifth Amendment.

Justice Anthony Kennedy announced the high court’s 5-4 decision. Justice Kennedy was joined by the four members of the court’s liberal wing—Justices Ruth Bader Ginsburg, Stephen Breyer, Sonia Sotomayor and Elena Kagan—while Chief Justice John Roberts dissented, joined by Justices Antonin Scalia, Clarence Thomas and Samuel Alito.

The court’s majority said the Defense of Marriage Act “violates basic due process and equal protection principles applicable to the Federal Government.”

A few quick excerpts as we continue to sift through the 77 page decision:

“The federal statute is invalid, for no legitimate purpose overcomes the purpose and effect to disparage and injure those whom the State, by its marriage laws, sought to protect in personhood and dignity. By seeking to displace this protection and treating those persons as living in marriages less respected than others.”

From page 20:
“There is a “careful consideration” standard: In determining whether a law is motivated by improper animus or purpose, discriminations of an unusual character especially require careful consideration. DOMA cannot survive under these principles.”

Bottom of page 25-26:
“The federal statute is invalid, for no legitimate purpose overcomes the purpose and effect to disparage and injure those whom the State, by its marriage laws, sought to protect in personhood and dignity. By seeking to displace this protection and treating those persons as living in marriages less respected than others.”
